White House Presses Court to Dismiss Immigration Lawsuit

The fight brought by various states and other local entities against Obama’s so-called Executive Order on immigration is only just beginning, and now the White House is pushing back, according to RCP.

A case brought by the iconic Arizona Sheriff Joe Arpaio against the administration is being challenged by the Justice Department in a court filing this week in which it charges Arpaio’s suit as ‘meritless’.

Arpaio’s suit argues that President Obama’s program of essentially refusing to enforce existing immigration law threatens to create a ‘magnet’ for more illegal immigrants, many of whom already have criminal records or who may commit felonies upon arriving.

In it’s brief, the DOJ fired back, “[The program] does not grant legal status to any alien. Rather, it authorizes a temporary exercise of prosecutorial discretion on a case-by-case basis for certain individuals who have been in the United States since 2010 and have deep ties to the community.”
